Equal Employment Opportunity Commission (EEOC)

Why did the Equal Employment Opportunity Commission (EEOC) issue guidance about artificial intelligence (AI)? 

 

The EEOC recognizes that many large on-line recruiting/hiring websites are using AI driven algorithms to help parse through the vast number of on-line resumes to channel the appropriate candidates to employers.  The EEOC is concerned that these AI algorithms may discriminate against minorities and inadvertently screen out these candidates from employer consideration. The EEOC’s guidance reminds employers that this is illegal and that even if the employer is using a third party (which in turn is using the AI) the employer remains legally liable for any inappropriate use of AI by third parties when screening employment candidates.
