ew York has issued a “Go to Jail” card for employers.  Historically, employers which didn’t pay appropriate overtime, minimum wage or other owed wages to employees could be liable for the unpaid wages in a civil lawsuit.  Now, New York has upped the ante and enacted a law that can make employers criminally liable, under a larceny theory, for such unpaid wages.  It remains unseen whether other states will follow in New York’s footsteps, but it is a reminder to employers to always focus on wage and hour compliance.
