An employee just requested a disability accommodation

Our company only has 6 employees and an employee just requested a disability accommodation in order to do his job – do we have to make this accommodation?

The Americans with Disabilities Act (ADA) only applies to employers with 15 or more employees.  However, many states, including Pennsylvania, have laws that mirror the ADA mandate to provide reasonable accommodations and apply to much smaller employers.   In Pennsylvania, the Pennsylvania Human Relations Act (PHRA), which mirrors much of the ADA, applies to employers with four or more employees.  Accordingly, even small employers should examine their duty to reasonably accommodate disabled employees.
