How often does the EEOC actually sue employers?

The EEOC receives and investigates roughly 80,000 thousand complaints of discrimination every year.  While it has the power to sue employers, it very rarely does so.  According to preliminary data, it appears that the EEOC filed approximately 143 lawsuits in fiscal year 2023.  About forty percent of these cases involved systemic or class action lawsuits.  The remaining lawsuits, around 86, were filed on behalf of individual employees.  While this represents far less than one percent of the charges filed, it does represent almost double the number of cases filed in the last three fiscal years.
